These terms apply to all visitors, customers, and others who access the Site or enter into a service agreement with us.
Mountain View Concrete Services provides residential and commercial concrete contractor services in Mountain View, CA and surrounding areas, including but not limited to concrete driveways, patios, sidewalks, foundations, retaining walls, flatwork, and related work.
All services are subject to a written agreement between the parties. Nothing on this website constitutes a binding offer or contract for services. A project does not begin until a written scope of work and estimate are agreed upon by both parties.
All estimates provided by Mountain View Concrete Services are based on the information available at the time of the site visit and the scope described by the customer. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Final pricing may differ from the initial estimate if the scope of work changes, if unforeseen site conditions are discovered during the project, or if the customer requests changes to materials, finishes, or dimensions after work has begun.
Any change to the agreed scope of work requires a written change order signed by both parties before the additional work proceeds. We will not perform out-of-scope work without documented authorization.
Project start dates are scheduled after a signed agreement and any required deposit are received. Start dates are subject to weather conditions, permit approval timelines, and material availability. We will notify you promptly of any changes to the scheduled start date.
Customers may cancel a project prior to the start of work by providing written notice. Cancellations made fewer than 5 business days before the scheduled start date may result in forfeiture of any deposit paid, as it may cover materials ordered or scheduling costs already incurred.
We reserve the right to delay or reschedule work due to unsafe weather conditions, permit delays beyond our control, or other circumstances outside our reasonable control. We will communicate any such delays as early as possible.
Payment terms are specified in the written project agreement. Typically, a deposit is due at the time of signing, with the remaining balance due upon completion of the work unless otherwise agreed in writing.
Final payment is due upon project completion. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by California law, whichever is lower.
Nonpayment may result in suspension of work, placement of a mechanics lien on the property, or pursuit of other remedies available under California law.
For projects requiring a building permit, Mountain View Concrete Services will apply for the required permit on behalf of the customer unless otherwise agreed. Permit fees are typically included in the project estimate; any additional fees imposed by the local jurisdiction after the estimate is issued will be passed through to the customer.
The customer is responsible for ensuring that any applicable homeowners association approvals are obtained before work begins. Delays caused by missing HOA approval are not the responsibility of Mountain View Concrete Services.
Mountain View Concrete Services warrants that all work will be completed in a workmanlike manner using materials suitable for the application. Any warranty specific to a project will be described in the written project agreement.
Concrete is a natural material and is subject to cracking, color variation, and surface changes over time. Minor cracking, surface discoloration, and cosmetic variation are inherent characteristics of concrete and do not constitute defects. Our warranty covers structural defects resulting from improper installation or workmanship.
Warranties do not cover damage resulting from misuse, improper maintenance, accidental damage, acts of nature, soil movement beyond what is reasonably foreseeable, or modifications made by the customer or a third party after project completion.
To the fullest extent permitted by California law, Mountain View Concrete Services shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to our services or this website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from a project shall not exceed the total amount paid by you for that specific project.

If informal resolution is not possible, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Mountain View, California. Both parties waive the right to a jury trial and to participate in a class action.
These Terms and Conditions and any service agreement between you and Mountain View Concrete Services are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute not resolved through arbitration shall be brought in the state or federal courts located in Santa Clara County, California.
